CENTERVILLE —
An Appanoose County man convicted in 2009 in federal court in Iowa for possession of a firearm by a felon recently was given probation after a recent firearm possession conviction.
Jeffrey Scott Hayes, 46, of Moravia, was sentenced on Jan. 8 by Judge Daniel P. Wilson to five years in state prison, suspended, to three years probation with the Department of Corrections, fine and submission of a DNA specimen.
Hayes entered a negotiated, voluntary guilty plea to the charge in July 2012. The same day Hayes entered his guilty plea an order was issued stating Hayes was to be released from state custody pending sentencing so he could answer to federal charges.
According to court documents, Hayes was in federal custody as of August 2012. Hayes was released from the federal prison in Leavenworth, Kan., on Dec. 11, 2012.
According to the criminal complaint filed by Appanoose County Sheriff's officer Todd Craver on Dec. 6, 2011 Hayes was seen in the 30000 block of 405th Avenue allegedly carrying a shotgun while hunting. A search of property owned by Hayes in Moravia turned up a 12 gauge shotgun and shells.
Hayes owes $1,152.50 for this case.
Appanoose County Attorney Richard Scott filed trial information on Jan. 19, 2012 accusing Hayes of felon in possession of a firearm or offensive weapon, a class D felony. The offense date was Dec. 5, 2011.
In 2009 federal court Judge James E. Gritzner sentenced Hayes to five years in federal prison suspended to three years supervised release on the charge of prohibited person in possession of a firearm.
