A Centerville man on pretrial release awaiting sentencing was arrested Feb. 27 and charged with fifth degree theft, unlawful possession of a prescription drug and filling a false report to law enforcement authorities.
Tristan Dean Boyd, 22, on Feb. 23 had reached a deal to plead guilty to an aggravated misdemeanor. He had originally been charged by Appanoose County Attorney Richard Scott with one count of possession of a controlled substance, Vicodin, with intent to deliver, a class C felony, for an incident that occurred on Aug. 22, 2009.
Judge Kirk A. Daily on March 5 found Boyd guilty of the charge of possession of Vicodin, a serious misdemeanor, and sentenced him to 180 days in the county jail, with all but 21 days suspended, and two years probation. The judge ordered Boyd to pay a $315 fine, 35 percent, $10 D.A.R.E. and $125 law enforcement initiative surcharge, restitution, if any, for court-appointed attorney fees, court costs and correctional fees.
According to the criminal complaint, Boyd on Sept. 7 in 2009 at the Law Center during an interview admitted he gave what he thought was hydrocodone to Waylon Dale Cole, 28, the night of Aug. 22, 2009 while at 21861 Highway J46. Boyd admitted he had stolen the pill from his father.
Boyd is scheduled to appear in court on the three new charges March 10 at 8:30 a.m.
