CENTERVILLE —
Criminal cases involving charges of sexual abuse, assault, harassment, going armed, carrying weapons and drunken driving were recently adjudicated in the Appanoose County Courthouse.
• Donnie Paul Sindelar, 43, of Centerville, originally charged with second degree sexual abuse, a class B felony, was sentenced June 15 by Judge Kirk A. Daily to a fine, 365 days in jail, suspended, credit for any time served and two years probation to the court on the reduced charge of assault causing bodily injury, a serious misdemeanor. Sindelar entered a voluntary, negotiated guilty plea to the reduced charge.
According to the criminal complaint filed June 20, 2011 by the Appanoose County Sheriff's office, Sindelar admitted he had "hand to skin contact with the genitals of a minor" 12 years of age at a residence in the 500 block of North 10th Street in Centerville sometime before 2008.
The court issued a five-year no-contact order to protect the minor from Sindelar.
The court dismissed the original charge on June 27.
Sindelar owes $540.25 for the prosecution of this case.
Sindelar was convicted of second degree theft, a class D felony, in Appanoose County in December of 1996.
• Timothy Dean Butler, 37, of Centerville, entered a voluntary, negotiated guilty plea March 16 to operating a vehicle with intent, third offense drunken driving, a class D felony, and on May 25 Judge Kirk A. Daily sentenced him to five years in state prison, suspended four years and 11 months of prison, five years probation to the Department of Corrections for the Eighth Judicial District, credit for any time served and a fine. Special terms of probation require Butler to complete substance abuse treatment and a drinking driver's course.
The criminal complaint filed Oct. 24, 2011 by Centerville police department states Butler has three prior OWI convictions in Appanoose County and one in Putnam County, Mo. Centerville police arrested Butler in the 200 block of East Maple Street in Centerville on Oct. 22, 2011 at approximately 2:43 a.m.
Butler owes the state $4,408.75 for the prosecution of this case.
• Danny Ray Powers, 25, of Centerville, charged with going armed with intent, D felony, first degree harassment and carrying weapons, both aggravated misdemeanors, was sentenced June 15 in the Appanoose County Courthouse. Judge Kirk A. Daily sentenced Powers to two years in state prison for first degree harassment and two years in state prison for carrying weapons, with the sentences to run consecutive with one another.
"Consecutive sentences are appropriate because of the nature of the offenses involving threats of a forcible felony to one victim and carry and displaying a dangerous weapon to law officers," Judge Daily wrote in the written plea, judgment and sentence order filed June 15, 2012. "Consecutive sentences are the best way to protect the community from further offenses by the defendant."
Powers entered a voluntary, negotiated guilty plea to the charges on May 25.
The charge of going armed with intent and fifth degree criminal mischief were dismissed by the court on June 15.
According to the criminal complaint filed by Centerville police on March 15, 2012, Powers, while in the 700 block of West Jackson Street in Centerville on March 14 at approximately 5:10 p.m., threatened to kill Jenna Wilkins and approached a clearly marked Centerville police car and officers while carrying a knife behind his back.
"Despite several commands to drop the knife and to stop approaching my patrol car, Sgt. Mike Moore and I were forced to draw our duty weapons and order the defendant onto his stomach where I placed him into handcuffs," Cody Jellison, Centerville police officer, wrote in the criminal complaint filed March 15.
A five year no contact order was issued against Powers to protect Wilkins.
Powers owes the state $448 for the prosecution of this case.
