CENTERVILLE —
A Centerville man sentenced to serve 15 years in state prison following a criminal conviction in Polk County was sentenced to five years in state prison in Appanoose County.
Brandon Lee Gooden, 32, of Centerville, was charged by Appanoose County Attorney Richard Scott by trial information on Nov. 27, 2012 with one count of manufacture, delivery or possession with intent to manufacture or deliver morphine on June 23, 2011 in Appanoose County, a class C felony.
On Jan. 8, 2013 Gooden filed a written arraignment and plea of not guilty to the charge contained in the trail information filed by Scott on Nov. 27.
On Jan. 8 Scott filed an application to amend the trial information to include count II — gatherings where controlled substance used, a class D felony — alleging Gooden on June 23, 2011 in Appanoose County unlawfully, willingly, knowingly sponsored, promoted, aided and assisted a meeting, gathering or assemblage with knowledge or intent that a controlled substance be distributed, used or possessed, morphine.
On Jan. 8 Gooden entered a voluntary, negotiated guilty plea to count II of the amended trial information.
Gooden Jan. 8 was sentenced by Judge Daniel P. Wilson to five years in state prison at Clarinda Corrections Facility, fine, 180 day revocation of driver's license, DNA specimen and credit for any time served.
Judge Wilson ordered his prison sentence to run concurrently with the prison sentence Gooden was given in Polk County on Jan. 17, 2012.
Gooden owes Appanoose County $361 for this case.
Count I was dismissed by the court on Jan. 8.
The compliant and affidavit filed Sept. 19, 2011 by Centerville Police Department and South Central Iowa Drug Task Force officer Jeremy Engle states the afternoon of Thursday, June 23, 2011 Gooden delivered prescription morphine medication to a confidential informant working with the South Central Iowa Drug Task Force at Gooden's residence, 200 1/2 W. Van Buren St. Apt. 2.
Appanoose County isn't the only Iowa county Gooden has been convicted of criminal charges.
Gooden has been a prisoner at Clarinda Correctional Facility due to a criminal conviction and sentencing in Polk County on Jan. 17, 2012.
Judge Scott D. Rosenberg in Polk County sentenced Gooden to a fine, 10 years in prison, DNA sample, 180 day driver's license revocation, credit for 139 days served for the charge of controlled substance violation, morphine, a class C felony and five years in state prison for failure to affix a drug tax stamp, a class D felony. The judge ordered the two prison sentences to run consecutive to each other.
The Polk County sentence means 15 years in state prison for Gooden. The prison sentence handed down in Appanoose County does not add to the time Gooden will serve in prison.
Gooden owes Polk County $1,266.29.
