CENTERVILLE —
A Centerville man arrested and charged with two crimes involving a 14-year-old girl had his case adjudicated.
Mark Eugene Eyler, 59, was charged by temporary acting prosecuting attorney in Appanoose County, Rick L. Lynch, on May 29, 2012 with one count of assault with intent to commit sexual abuse, no injury and one count of attempt to entice a minor, both aggravated misdemeanors.
Eyler several times failed to show for his arraignment on the two charges. Eyler was arrested by the Des Moines Police Department at 2121 University Ave. in Des Moines Aug. 26 and brought back to Appanoose County to face arraignment.
Eyler entered a voluntary, negotiated guilty plea to the enticement charge on Sept. 28, 2012. The offense date for both charges was April 19, 2012.
Judge Kirk A. Daily in the Appanoose County courthouse courtroom Oct. 12, 2012 sentenced Eyler to two years in state prison, suspended, two years probation to the court, fine and credit for any time served on the charge of enticement of a minor.
The complaint and affidavit filed by Centerville Police Department Officer Tyson Howard on April 20, 2012 states Eyler at approximately 6:03 p.m. April 19 in the 400 block of North 10th Street in Centerville allegedly initiated physical contact with a 14-year-old girl with the intent to commit sexual abuse as she walked along the sidewalk. Eyler allegedly told the girl she was pretty, offered her a cigarette, hugged her and asked her if she wanted to come inside a nearby garage.
The girl escaped and was taken home by a friend.
A no contact order to protect the girl was issued by the court on April 20.
The charge of assault with intent to commit sexual abuse, no injury, was dismissed by the court Oct. 12, 2012.
Eyler owes $1,177.99 for this case.
